Who is affected by this regulation?
The regulation concerns passengers departing from one of the 28 EU Member States, as well as from Switzerland, Norway and Iceland. Passengers are all concerned, regardless of their nationality. Also concerned are passengers taking an insured flight by an EU-based airline to one of the member countries, Switzerland, Norway or Iceland.
In case of delay with Tap Portugal
In case of a long delay (from 2h to 4h, for a distance between 1500 km and 3500 km), a passenger can get a refreshment, a meal, a hotel room or a transfer to another airport.
If the delay is greater than 5 hours, the passenger may request, in the event that he renounces his trip, the reimbursement of his plane ticket.
In case of denied boarding or cancellation of flight:
In both situations, the rights and indemnities are the same.
If there is denied boarding or cancellation imposed, it has the choice between being placed on another flight or be refunded his ticket. The carrier must in this case make the refund in cash, by check or by transfer.
Unless otherwise agreed by the passenger, compensation for travel vouchers is not allowed. It can go from 200 to 600 euros.
Warning, there are situations where even in case of cancellation, the company is not required to refund passengers:
– passengers are informed at least two weeks before the flight;
– if a seat is offered on another flight departing approximately at the scheduled time;
– if extraordinary circumstances require it (weather, strike action at airports, bird strike, etc.).
